Medical Malpractice – Medical malpractice is the act of medical negligence committed by a doctor, nurse, or member of a hospital staff that causes unnecessary injury to a patient. In order to pursue a medical malpractice case, 4 factors need to come into play. The first of these is “duty,” which establishes a relationship as well as a requirement between a patient and their doctor or medical professional. The second is “medical negligence,” which refers to deviating from the standard of proper medical care. Examples of medical negligence can include a failure to make the correct diagnosis of a patient, making surgical errors, and failure to follow up with treatment of a patient. The third element that needs to be present in order to have a legitimate medical malpractice case is “patient injury.” This injury must be unnecessary or undue and must have caused enough damage to seek compensation for. The fourth and final factor is “causation,” which means demonstrating how the medical negligence caused the undue injury to the patient. If all four of these factors are present, then it’s safe to say that you have a valid medical malpractice case.
